"Rewriting the Rules of Free Speech" is a workshop examining the efforts of prosecutors across the country to challenge the precedent set in Ashcroft v. Free Speech Coalition in cases involving AI-generated CSAM. In the 2002 Ashcroft decision, the Supreme Court ruled that content not involving real children did not cause societal harm and was therefore protected under the First Amendment. However, advances in AI technology since then have made it increasingly difficult for the average person to differentiate between AI-generated CSAM and material involving actual children. This workshop will explore the latest developments in AI and demonstrate potential legislative and judicial solutions to Ashcroft.
